1. Putting Our Agreement in Place
1.1 The terms ‘Ken Bailey at Wistow’ or ‘us’ or ‘we’ or ‘our’ refer to the owner of the website. Ken Bailey at Wistow is the trading name for K G Bailey Limited. We are registered as a Limited Company in the United Kingdom. Our company registration number is 03704610 (Registered Office – Business Services (Leicester) Ltd, The Manor, Main Street, Tur Langton, LE8 0PJ).
1.2 The terms ‘you’ or ‘your’ refer to a user of this website and person(s) detailed on the order form.
1.3 Our agreement is made on the date of purchase.
1.4 Our agreement includes all correspondence from us to you and the description of goods as provided by us on our website (www.kenbaileyatwistow.co.uk) or otherwise.
2. Basis of Sale
2.1 The terms of this, our agreement with you, shall govern our contract to the exclusion of any other terms and conditions.
2.2 No variation to this agreement shall be binding unless agreed in writing by us.
2.3 Any typographical, clerical or other error or omission in any sales literature, price list, acceptance of offer or other document or information issued by us is subject to amendment by us where reasonable under any circumstances.
2.4 You are responsible for ensuring the accuracy of your order and the details provided in your order form.
2.5 The quantity and description of your chosen products shall be those set out in the order form unless we subsequently agree otherwise.
2.6 The pictures may not be an absolute true representation of the item, and colours may vary in certain cases (all pictures, where possible, have been supplied by manufacturers).
3. Ordering
3.1 It is a condition of purchase that you are aged 18 and over at the time of order confirmation. If you are under 18, you must get parental or guardian permission to make a purchase.
3.2 Payments are made with most major cards including: Visa, Mastercard, Paypal, Apple Pay, Google Pay, American Express, Klarna.
3.3 Inaccuracies may occur on our website, whether it be price or description or availability of the product you have ordered. In this instance we will contact through the details you have provided on your order form and you will be given the choice:
3.3.1 Cancelling your order whereupon we will refund the price you paid.
3.3.2 Substitute products will be discussed with you and agreed upon. Should no substitute be available, we will cancel your order and refund the price you paid.
3.3.3 Agreeing upon an extended time period to receive your chosen products after which if your chosen product is not available then options 3.3.1 and 3.3.2 will be available to you.
3.4 Should you choose option 3.3.1 then your refund will be given with the original method you used for your purchase.
3.5 You have 14 calendar days starting from the day after your order confirmation to cancel your order. To cancel your order, you must notify us in writing, which includes e-mail to sales@kenbaileywistow.com. Please refer to our Returns & Exchanges Policy for information regarding the return of unsuitable received goods or the return of faulty goods.
4. Returns
4.1 You must make contact with us in writing, including e-mail to sales@kenbaileywistow.com, before returning any product to us for the following reasons:
4.1.1 If you’ve had a change of mind, you may return the products to us, provided the products are returned in their original re-saleable condition, unused and with any original labels and packaging intact and must be received by us within 30 days of your receipt of goods for a full refund. If this is not adhered to, your refund request will be nullified. Unless otherwise agreed by us in writing.
4.1.2 You may request replacement products, which we will dispatch to you (subject to availability) on receipt of the original products, which were not satisfactory to you. We only permit 30 days from your order receipt for this action to occur. Any returning items must be in their original packaging, unused and in a resaleable condition. Unless otherwise agreed by us in writing.
4.1.3 Faulty or damaged goods should be returned within 30 days of your order receipt and a refund will be issued on inspection of the goods.
4.2 You must refer to our Returns & Exchanges Policy for more information before making contact with us, all products/services are subject to return charges.
5. Price of Goods
5.1 The price of goods quoted by us on the order summary page of our website will be the price of goods purchased unless otherwise agreed by us in writing.
5.2 All prices of goods include VAT unless otherwise stated.
5.3 Delivery costs are excluded from the price of goods and will be calculated separately during the order process.
5.4 The price of goods is inclusive of any payable VAT in the UK.
5.5 We reserve the right to amend any typographical clerical error or omission to prices where reasonable to do so.
6. Risk and Property
6.1 Risk of damage to or loss of your chosen products shall pass to you on delivery of the products.
6.2 Notwithstanding delivery and the passing risk in your chosen products or any other provisions of this agreement, property of your chosen products shall not pass to you until we receive cleared funds payment in full of the price of your chosen products.
7. Warranties
7.1 We warrant that you will be entitled to the benefit of any warranties or guarantees given to us by our supplier for your ordered products. This does not affect your statutory rights.
7.2 You warrant that the information entered onto the Order Form is true.
7.3 Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.
8. Force Majeure
8.1 We shall not be liable to you or be deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control:
8.1.1 Act of God, explosion, flood, tempest, fire or accident.
8.1.2 War or threat of war sabotage, insurrection, civil disturbances or requisition.
8.1.3 Acts restriction regulations bye-laws, prohibitions or measures of any kind of the part of any governmental, parliamentary or local authority.
8.1.4 Import or export regulations or embargoes.
8.1.5 Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of us or of a third party).
8.1.6 Power failure or breakdown in machinery.
9. General
9.1 If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
9.2 The Contract shall be governed by the laws of England.
9.3 We reserve the right to make changes to our Terms & Conditions at any point.
10. Free Gifts
10.1 Where free gifts may be given with certain orders and promotions, a cash alternative shall not be offered.
10.2 A purchase of non-promotional items is necessary as per the terms laid out for each free gift.
10.3 Refunds or returns of free gifts is not permitted.
11. Coupon Codes
11.1 Some products may be excluded from any coupon codes in circulation at our discretion and removed without notice.
12. Whole Agreement
12.1 The terms and conditions set out in this Agreement represents the entire Agreement.
